Clinic Loses Appeal In Doctor Negligence Case

Ferrell-Duncan Clinic has lost an appeal in a case in which a doctor was found liable of negligence.

A Greene County jury awarded Alfred C. Cole damages after finding a doctor failed to order certain tests when Cole went for physical examinations in 1997 and 1999.

Cole's attorneys argued the negligence caused Cole to lose part of his chance for recovery after he was diagnosed with cancer in October 2002.

Appellate judges Jeffrey Bates, Phillip Garrison and Kenneth Shrum determined last week that former Circuit Judge Henry Westbrooke correctly overruled the objections.
